    Default Creating Paintings From Pictures, and Copyright

    I sell paintings that are from people photos. One question that is asked repeatedly is what is legal or not. I know paintings before 1926 are public domain so I can paint any Van Gogh etc. However, what can I have painted without running the risk of a lawsuit. Are photos of famous people ok? Are photos that are copywrited ok since they are "an artist interpitation?" And paintings of artwork done after 1926 like Thomas Kinkade. I have got 20 different answers from people that know the law.

    Well one of my best friends is in law school and he got sick of my asking all these questions that had nothing to do with his main course study. So here I am getting all of these off my chest. I am not sue happy but Law plays a big role is everything everyone does.

    So you have my life story now!

    The photographs of famous people are subject to copyright protection. The famous people likely enjoy additional protections due to their right to protect (and profit from) their likeness. If you want to sell paintings of famous people, focus on politicians (who in the U.S. have few rights to their likeness) as opposed to other celebrities (who may have significant rights, and significant inclination to sue).
