    Default Change my son's last name to mine

    When my son was born I was not there. The mother did not wait for me to sign the birth certificate. At this time I would like him to have my last name instead of her maiden name or married name. He was born in Montana where I still reside and the mother lives with him in Florida now. She most likely would not agree to do this.

    I was paying child support until she moved. We had a verbal agreement that she would not ask me for money since he and her husband make 100k a year and I make 12K. I am the last male in my family with this name without going back over 100 years to find a distant relative and it has always bothered me that I was not able to sign the birth certificate and give him my name. I was 17 when this happend.

    Assuming you have established your parental rights, you would have to convince the court with jurisdiction over custody issues that the name change is in the best interest of the child. That would not be easy (to put it mildly), so if you wish to try it you should consider consulting a lawyer.

    The fact that OP is not paying child support will not help his case.
