    Default Can You Get Emancipated if Your Parents Kick You Out

    My question involves guardianship in the State of: California
    im 16 years old almost 17 in November 4 .I had problems at home with my parents and they kicked me out can I get emancipated for my parents doing that and since im almost and adult can that be possible of me getting emancipated with out my parents approval

    What is the source of the income that will allow you to pay all of your own expenses (rent, food, clothing, utilities, transportation, health care, insurance, staples, school fees and supplies, etc.) without any help?

    In the state of California, if your parents do not support your petition for emancipation, it will not happen. Even if you are already supporting yourself 100%, which it does not appear that you are doing.

    How have you been surviving to this point? How are you earning money? With whom are you living? (And if the person or family you live with includes a love interest, then you can all but kiss any emancipation chances goodbye.)

    If your parents are not caring for you, then you might put in a call to the police or to CPS. But, that will not get you emancipated, either.

    If mom and dad have kicked you out of the house and acquiesce to your remaining out of the home, then that particular element of emancipation may be met. But, you still have to show that you can support yourself without aid and assistance, and that you can continue schooling, and that emancipation is in your best interest. It may well be that the state will decide that foster care is in your best interest.

    And, from experience, I have found that when the child claims to have been thrown out of the house, the parent generally says that the child left of their own accord.
