    Default Getting Emancipated Over Stressful Home, Despite Low Grades and Income

    My question involves juvenile law in the State of: Colorado.

    Hello! I am a 17 year old female living in the state of Colorado. Briefly said- I have been wanting to file for emancipation and found this sight concerning laws on the subject. I understand emaciation would be very hard to achieve- I was going to see if you thought these were some legit reasons to file.

    For some years I have been living here with my biological mother, step father, 1 half brother (age 11-has ADHD), 2 step brothers (10, 12-Autistic), and a half sister (age 2.5, almost 3). I feel that I am ready to spread my wings, go off into the world without being held back by my family- especially my mother who is majorly over controlling and must have a say in every aspect of my life. For years now- she has been emotionally abusive- the stress from the abuse and family life has taken its tole on my education. I have a 1.9 GPA but am on track to graduate as of this year.
    I have a job working for an Animal Hospital- been here for a year and a half making $7.25 per/hr. I would have a home with my fiance whom I have been with for 3 years. Out of high school I also have a job with a groomer so I can fully support myself.

    ~Would this be a possible case that is excepted so I can file for emancipation?

    No.

    To start with, Colorado does not have a statute to emancipate a minor. In some limited conditions when you have been living ON YOUR OWN (not with your boyfriend) and paying 100% of your own support (not living in someone else's house while they pay some of all of the rent, utilities, and groceries) Colorado MIGHT deign to consider you emancipated, but that's about the best you're going to get.

    In the second place, the law is not in the habit of making exceptions. Either you qualify to be emancipated or you don't. You don't, even if your state had such a statute, which THEY don't.

    Emancipation is not and never was intended to be a means for a minor to leave home, regardless of how bad the home situation may be. It was and is intended to be a means to provide legal protections to those minors who, for reasons outside their own control, found themselves living on their own.
