    Default Reduction in Hours

    I am employed in Illinois by a mid size manufacturer. We have experienced reduced work weeks on and off for last 10 years. There are 4 in my department doing the same job. We had been on a 90% reduction and last week we were advised this would go to 80%. I was then advised that 3 of the people are without spouses, or spouses are on unemployment so as it would cause them a hardship, they would remain on 90% and only I would be reduced to 80%. Can they legally do this?

    If they were only doing it for people without spouses, that would be a problem under your state's laws. However, since they are also doing it for people whose spouses are unemployed, it is not a violation of discrimination laws since they are not singling people out on the basis of a protected characteristic.

    I suppose a really, really good lawyer might be able to make the case that "people whose spouses are employed" still falls under "marital status" protection, but where the employer is obviously trying to cut their employees with only one income a break, I'm not sure how many lawyers would be interested in taking up the issue, particularly where it's a weak one at best.

    Figure a lawyer would want either a retainer.....or would work for the winnings, then take 30-40% of it.....

    Well since the "winnings" would be to have the hours restored, I'm betting on a retainer.
