    Default Guardianship of a Teen Minor Being Released from Juvenile Detention

    My question involves guardianship in the State of: California

    My son has a friend that is close to our family for many years. He has gotten into some problems with the law. He is at a juvenile detention center for almost a year. He is getting out in November and is not allowed to go back to his home with his mother. We are considering accepting him to come live with us. Since this involves the courts I am having problems getting clear information online. Will his parents still have to support him financially? What about medical? Would the state provide any financial aid? I know it will not be easy taking in another child but I do want to help but financially the burden would be too hard.

    If you cannot accept the financial burden, then you should not consider taking this child in. In fact finances would be the least of your problems. His behaviour issues and the effect he will have on your children is something you need to consider.

    Maybe and maybe....

    If this placement is through protective services in the form of foster care, foster parents get a modest payment and the child can independently qualify for certain public assistance such as Medi-Cal. If it's going to be a guardianship placement through the juvenile court, read this. If it's going to be a guardianship through the probate court, you can petition for child support, that the child be maintained on the parents' health insurance (if available and affordable), and the like.

    If this is a voluntary placement by the parents that does not go through a court or protective services, then you can ask that the parents contribute to the cost of care as part of that voluntary arrangement.

    If you are placed as a foster parent, you must qualify under state laws. This usually involves a background check, classes and home review approval. It might vary for your area.
