    Default In the State of Alabama, How Can I Divorce My Incarcirated Spouse, Inexpensively

    My question involves a marriage in the state of: Alabama

    No shared assets. One child involved. He was served by my attorney and is not in agreement, contesting the terms of divorce. He wants have of my income tax for 2013, eventhough, he was not included on the return, nor did we reside together. Also, he does not want to pay child support or want supervised visitations. LOL!! No judge would go for that I know. I can't afford to pay $2,000.00 for a contested divorce. My husband is a sexual offender and I was not aware when marrying in 2007. He has numerous charges for drugs, robbery, possesion of stolen property and has been in a state facility for 1 year now. He is jailed under another name, the name the offense was committed under. His legal name is what we are married with, fortunatly, I never changed my name. If I proceed to file myself, do I need to write a letter relieving my "attorney" of his services? I still have to original decree that he drafted. He typed 6 b/c he had incorrect dates, mispellings and was very lax in correspondance. I was told by local legal aid I did not qualify for assistance because we had no documented history of physical abuse, allthough, there was a history of violent physical abuse by the defendant. My bring home pay is only $1,200.00 a month. How is that possible?

    You'll generally have to "fire" the attorney in writing (and likely have to inform the court, too).

    But you file for child support. Now. Even though he's incarcerated. He doesn't get out of the obligation that easily!

    Legal aid rarely deal with divorces - specially contested divorces.

    And with respect, may I suggest something (you probably know this already)?

    Next time you get involved make darned sure you've run a background check and Google'd the living daylights out of the prospective suitor. You can't be too careful these days
