    Default Retaliation and Ethnic Harrasment

    My question involves labor and employment law for the state of: Texas

    In May of this year I turned in my Supervisor and my team leader to my HR department because I was getting bullied and harassment from both of them including in-direct job threats, remarks about my ethnicity, and both of them were doing in front of other team members. After I turned in issue to my HR, they start harassing me even more and started retaliating against me to the point where I had to keep my mouth shut or get more harassment and bullying. Long story short on my last day my team leader made a in-direct remark about me getting fired and then he sent me a text with a picture of a police officer dragging a pig and it said " Son of a bitch burned down my house, He had it coming". I decided to quit and left my job that night and sent a text to my team leader and my supervisor saying that I was fed-up with all this harassment and job threats. Day later I turned in a detail letter to my HR explaining everything in detail from top to bottom, HR decided to investigate the issue and after the investigation they asked me if I would be willing to go back to work if corrective actions were taken and I agreed to. Last week I got an e-mail from my HR investigator stating that I need to prepare to return to work next week and she will provide me more details soon.

    My last day of work was 07/28/2013 and I'm suppose to return to work next week, I was concerned when I go back to my job should I expect a pay cut or a demotion or anything like that?
    I know I havent provided enough details but at the moment Im concerned if I should be expecting a demotion or cut in pay or some other type of retaliation.

    Without knowing more about what form the bullying and harassment took, no way to say. Not all or even most of what the average Joe or Josie would consider bullying, harassment, or retaliation is illegal.

    The fact that HR has asked you to return to work would tend to indicate that they took your complaints quite seriously and that you should not suffer any retaliation, demotion or anything similar. If any of that were to happen then of course you should report that to HR.

    Remarks about ethnicity (as indicated in the original post) is likely why HR decided to take things seriously and why HR invited the OP back.

    I hope you kept that text. I would have considered that a threat and taken it to the police. (maybe I would have been overreacting, but some things just don't sit right, and that is scary, imo.)

    Yep, Saved all the texts and everything plus some documentation.

    What is so scary about this text?
    It sounds and looks like a threat. Exactly in what context should/would a boss (who you are not close with) send you something like that? Especially if you've had a contentious relationship.

    Update 09/10/2013
    I went back to work on 09/04/2013. The two guys that were harassing me were fired according to my management.
    So far work seems to be doing ok but my current team leader is trying to make me care and feel guilty and contact my HR and see if I can do anything to bring back my old team leader because he did everything because the supervisor told him to do so. I do care about the guy even though what he did was wrong and would like him to come back and have a job since he is the only source of income in his house and have kids.
    I suggested my current team leader to have him send a sincere apology letter to management and if it was ok with them I'll contact HR and let them know to give him another chance. But apparently they don't want to go that route which leads me to think about their motives. Any suggestions on what I should do?

    You want to know what their motives are? I'll tell you what their motives are. They want to keep out of legal trouble. If they brought him back and he started harassing people again they could get sued.

    You don't do anything. It's not your business any more.
