    It's legal.

    I saw nothing in your post that raised a suspicion that you would bill anybody for hours you didn't work so I don't know where the other responses came from.

    But, to be on the safe side, make sure your agreements include billing by the job and not by the hour.

    They can find out any number of ways that no one can predict.

    Any one or more of your employers (or clients) might not like it and terminate you for it. And that would be legal, too.

    I didn't see any such suggestion either - I mentioned it only to clear up any confusion about what is and is not allowed.

    I like the idea of billing by the job and not the hour.

    thanks a lot adjusterjack, I appreciate your response.

    yes, both these employers are billing by the job, and not by hour.
    in one of the jobs, I will be working with offshore 100% of the time - so that work is mostly in the evenings as per US timings.

    the role is Work-from-home, and to complete 40 hours a week - I can also work over the weekends to catch up.

    Would you have any idea, in what ways my employer can find out? Because I am sure I will be efficient enough to be on top of everything at both my jobs
    I just want to know, by running normal payroll and by generating W2 forms, can they find out?

    They sometimes find out when they ask you. If you are suddenly not available as needed for either job,'they might start to wonder why and ask about it.

    Unless there is some association between the two companies, they may very well never know of the other. But, some people talk a bit too much around the water cooler and before you know it, somebody has told the boss.

    No, they will not find out by running normal payroll and/or by generating W-2 forms.

    However, any given industry is a small world and employers know and talk to each other.

    If the OP is working for a bank, he/she will have to disclose the new job with the new firm and get formal approval. It is part of associate monitoring activities - very common industry standard.
