    Default What is the Statute of Limitations on Medical Bills

    My question involves collection proceedings in the State of: CA

    I have a medical bill from when my son was hit by a car. it was in 2007, I was unable to pay it and a collections agency took it over in late 2008 and put it on my credit. My question is what is the statute of limitaions on medical bills?

    Not sure it is applicable but I know in state close to you it is so I figured I would ask before searching:

    is the creditor a "public" hospital such as a county supported facility rather than a privately owned facility?



    while getting back with that, you need to realize there is a huge difference between the statute of limitations to be able to collect on a debt and the statute of limitations for reporting this on your credit report. General debt has a 4 year statute of limitations to be collectable (in California). It can be reported on your credit report for 7 years from first delinquency.

    JK's excellent response does not even delve into whether they take you to court and obtain a judgment. That can extend things even farther.

    actually it does. That would be the 4 year limitation. If the debt does not have some special allowances due to it being a public institution, after 4 years, the debtor can simply file an affirmative defense of the SOL having run out. Since it has been more than 4 years and if OP has done nothing to extend the SOL, they may be safe as far as being sued.
