    Default Non-Custodial Parents Uses Drugs

    My question involves a child custody case from the State of: Texas

    I have a 4 year old daughter who visits her father regularly and her father has smoke marijuana while she has been with him for visitation. Oddly enough, his wife and I keep in touch and she informs me of issues that are going on and she informed me that the father also order synthetic urine online to pass drug tests for work.

    I do not want my daughter left alone with him until he is clean for at least 60 days. Is there anything I can do or what would usually happen in this kind of situation?

    What proof do you have that your daughter is in any kind of danger.

    I do not have proof that she is in danger, but what if she is hurt and needs to go to the hospital and he is under the influence? Also, I have been informed that my daughter and her half sister were not being supervised while it was being done in the home. The father is also being kicked out of the house by his wife, and the last time this happened, he didn't inform me of anything that was going on.

    The only thing you can do at this point is inform the authorities IF you feel your child is in danger. You don't have the right to stop visitation.

    Why didn't this woman call the police if she knew the children were left alone? Where was she? This lady has an agenda and it may not be in your best interest to listen to her.

    She could have called the police which may have resulted in the father losing his job which means no child support for my daughter. The step-mother has my daughters best interest in mind when things come up and wants to make sure my daughter doesn't miss out.

    Nope, she is just baiting the bear. If she had your daughter's best interest in mind she would have called the police when the kids were left unattended. She wouldn't put his job, ahead of her child and your child.

    Again, until it can be proven that dad is unfit, you cannot withhold visitation.

    If you believe that you have grounds to do so, you can petition the court that has jurisdiction over your custody case to prohibit illegal drug use during visitation and to order periodic drug testing. As the detailed facts, court practices and judge assigned to the case could affect the outcome of any such motion, I suggest that you discuss the details and your options with a local custody lawyer.

    I agree that this could help; however, dad would have to be caught engaging in such illegal behaviour and mom has already indicated that dad has been able to circumvent testing - which may or may not be true.

    I have a lawyer whom has helped me in previous situations with the father, so I think I will be following up with him. I just want as much information as possible so I know what kind of leverage I have and what to expect.

    Dad may well be circumventing urine tests at work, but that doesn't mean he would pass a hair test, blood test, or a properly supervised urine test.
