    Exclamation Can Parents Send a Pregnant Teen to Juvenile Hall

    My question involves child abuse or neglect in the State of: California.
    I'm 16 years old living in california. I'm also pregnant and living in my mothers custody. She's threatening to send me away to juvenile hall in the morning. I'm pregnant and haven't committed any crimes or illegal acts. I was wondering if that was legal? Also considering I live with her and other family members, it is another family members house and not hers.

    If you are an unruly child, you possibly can be sent there. You obviously have a problem with exercising good judgment or you would not be pregnant.

    Disagreeable, your response is misleading at best. OP's mother cannot send OP to Juvie, only a judge can do this. (And I suspect OP would have advised us had a judge ordered her to be sent to Juvie.) And a judge would never send someone to Juvie just because she was pregnant. As far as OP's unruliness is concerned, you have no evidence whatsoever that OP is unruly. While the fact that she is pregnant may indicate unruliness, this is not necessarily so. OP may have allowed herself to become pregnant for a myriad reasons not related to unruliness.

    So here is the correct legal answer for OP:

    OP, your mother can't send you to Juvie on her own. She needs a court order to do so, and if she had said court order, you would know about it because said court order would have been announced in your presence. If you are not aware of any court order like this, then you are not going to Juvie this morning.

    Juvenile Hall is not a baybsitting service, and these days parents should not be surprised to get a bill for their child's stay. As eerelations says, you can only be placed in juvenile detention by a court.

    Your parents can, however, send you off to a residential boarding school or similar private enterprise, as long as they are willing to foot the bill.

    I was attempting to empower mom by my answer. It appears there is a power struggle in the home.

    Well, to be clear, while a judge can sentence the juvenile to juvenile hall, the police can also take the juvenile to the hall ... provided the juvenile has committed a criminal offense and is arrested.

    As there appears to be no criminal offense alleged at the moment, mom's threat appears to be an empty one. Though, if the OP is on probation and not adhering to the conditions of her probation ...
