Father Doesn't Want Me to Move Away With Our Child

My question involves a child custody case from the State of: Pennsylvania

Okay so my son was originally born in NC. We moved to PA where I used to reside about 6 months after he was born. Its been almost 4 years and ive been taking care of him financially on my own so i am now deciding to go back to school so I moved back with family in NC. He would see his father about once or twice a week. I told my father to tell him I was moving because I was afraid of what he might do because he has gotten physical in the past. But now he has filed for custody of my son. He is claiming that my son has lived with him his whole life and he has taken care of and had him 50% percent of the time all of which is untrue. He's not even on the birth certificate! Ive been trying to get legal aid because I don't have money for a lawyer but I cant get a hold of anyone and I cant go because im in NC. What should I do? If I don't have representation what will happen? Is there anything I can do to prove that this move BACK to where he was born was the best option so I don't have to move back and continue to struggle? Is there anyway we can do it over the phone?!I don't have enough money for a lawyer but I don't want my son to be taken away from me or for us to have to move back!!! I NEED HELP!!

You will need to go back and deal with the custody issues. It may be ordered that the child is not allowed to leave the area of residence. The child does have a right to mom AND dad.

The first thing you have to do is officially respond to the paperwork refuting dad's lies. Then, you are either going to have to travel to PA for court, or you are going to have to hire an attorney to represent you. Its also possible that you could be ordered to move the child back to PA.
