    Default How to Help My Sister Get Emancipated

    My question involves juvenile law in the State of: Texas
    My sister is 16 years old soon to be 17 . me and her both come from a bad childhood im at and was wondering if i can get legal custidy of her or if she can get emancipated? she works and has her own place to stay. shes trying to go to school but my mom will not sign papers to let her .. shes a junior in high school and wishes to complete it. my mom has abused us and has never really been there for us. shes left my sister in texas to fend for her self while she lived in colorado. she shouldnt even be allowed to call her self a mother i need someones advice to figure out what i can do for her .. please help

    Unless you sister is already living on her own and supporting herself, she does not qualify for emancipation under Texas law.

    That's extremely important.

    Sec. 31.001. REQUIREMENTS. (a) A minor may petition to have the disabilities of minority removed for limited or general purposes if the minor is:

    (1) a resident of this state;

    (2) 17 years of age, or at least 16 years of age and living separate and apart from the minor's parents, managing conservator, or guardian; and

    (3) self-supporting and managing the minor's own financial affairs.

    Ah, but does the place to stay involve living with her boyfriend/boyfriend's family/best friend/best friend's parents/other relative where she will be paying a token rent and they will be paying most if not all of her living expenses? That's what most teens mean when they say they have a place to stay. Especially since older sister/brother is asking about taking custody. That doesn't sound as if Lil Sis is self supporting.
