    Default How to Keep the House in a Divorce

    My question involves a marriage in the state of: Oklahoma

    I loan some money from my mom to pay my house in cash. My wife said to write her name on the deed and she will pay the mortgage together. But she didnt sign on the loan agreement.

    Now she left me and live in China. I'm still in Oklahoma. She didnt pay a cent on the house and bills, and wont pay in future. She wont't remove her name from the deed too.

    Could I sue her and remove her name from my house since she didn't fulfill her oral agreement. I still have debt to my mom now.

    If we're supposed to read that as, you were married when your mother loaned you money too buy a marital home, it's fundamentally not different from a bank loan - the equity in the home is determined by deducting the remaining debt from the market value of the home, and the equity is divided between the divorcing spouses.
