    Default Alimony After 2 Years of Separation

    My question involves a marriage in the state of: California

    Ex and I have been separated (nothing through court) since Jan 2012. Since early 2013 I have had my son 2 days a week and now i have him 7 days every 2 weeks. Ex still lives with parents and got fired october 2012 from her bank job that paid 20/hr and quit her most recent job (full time but only making commission) a few weeks ago to have more time to start filing the divorce papers. All i want is to get this divorce done and have 50/50 of my son and ex is threatening that if i dont reconsider less than 50%, she will get spousal support and/or alimony on top of child support. Is this possible after 2 years of separation?

    BTW we were married 4 years and 8 months before our separtion and have not combined assets.

    Whether you combined assets or not, anything accrued during the marriage is community property...so you are going to have to deal with a division of community property. Alimony after a less than 5 year marriage isn't very likely, but its not impossible either. However, it would be short term alimony.

    What kind of parenting schedule have you been following for the last two years?

    Well I was in the military up until last July and after I got out it started off with one overnight stay during the week and one during the weekend so my son can get accustomed to it. After my son felt more comfortable with me, it started with 2 nights during the week and 2 nights every other weekend. In february it went to 3 days and 2 nights every week starting in beginning of july, it was a 2-3-2 rotation because of my work schedule. He has his own things at my house and i never have to ask his mother for anything.
