    Default Will You Be Extradited for a Probation Violation or Burglary Charges

    My question involves criminal law for the state of: Colorado

    Will Colorado come extradite me from New York? I am 18 out of 24 months completed with a felony class F4 attempted theft probation, and I have 2 warrants issued as of now, one for felonly class 4 attempted burglary that surfaced from 2 years ago, and another for a new felony class 4 theft of which I am under investigation for.

    I understand that it depends on the severity of the charges etc. I read that they usually will not extradite for only F3 or higher or of course more serious violent charges. The theft charges were all under $4500. And the attempted burglary was for a broken door to a household.

    I understand how I would be living my life on the run. Does this also mean they would give me a felony escape charge? Would I be classified as a fugitive? I would imagine they would just issue a failure to comply for the unfinished probation... and of course the other charges would be pending. Thank you.

    Apparently, you already are a fugitive. I would plan on NY just arresting and holding you for two or three weeks, each time you come in contact for the law, to allow CO time to extradite you. Destroying your life and losing your home, over and over again is a good prompt to most people to return and face the charges on their own dime.

    That did not answer my question whatsoever, I have seen criminals not be extradited depending on the cost of pickup and severity of the charges.

    There is a very real possibility you will be extradited. The extradition decision regarding the individual warrants will be made each time you are picked up. The actual extradition decision is made at the local, not state level.

    If you want a definitive answers then you must call the jurisdictions which issued the warrants and ask them. They may or may not discuss their extradition policies with you. If not, than the only way to find out is to be picked up in New York and see what happens.
