    Default An Employee Took a Picture of My License Plate at a Store Where I've Shoplifted

    My question involves criminal law for the state of: Texas


    Today I was at a Walmart and thought about shoplifting, I had hit that store before not in about a month. Anyway, I was considering it but in the end had a bad feeling and did not do it. As I'm leaving I see an employee take a pic of my license plate, I confronted him and he said "stay out of my store I don't want any problems" I told him I didn't do anything and he was free to check me. So the question is, what can I be expecting? They don't have me taking anythu g and have never caught me and any prior taped would be circumstantial seeing as how I've never been caught and didn't take anything today.

    If you return, it is likely you will cited for trespassing. He clearly has proof he interacted with you. Who do you think the judge will believe? (Hint... it is not you)

    You may have been identified by camera from previous incidents. He acted to get your license plate to document in any current/future police reports.

    Stay out of the store and any WallyWorlds in that general vicinity as they are likely in the same district and share intel.

    He cannot get any information from your license plates ...

    If the car is back in the store area, it means little ~ him seeing YOU is another matter.

    The plates will likely not be allowed into evidence anyway.

    This was a walmart in a different town, but yes, likely in the same district. As far as I know however, as long as you werent actively caught with merchandise by store employees its all circumstancial as you could have just dumped it in a different area of the store. Correct?

    I know if the police show up I didnt take anything in any store. Today I did not take a thing however, left just as empty handed as I walked in.

    Not necessarily. In theory, they could have you dead to rights on video/floor surveillance from start to walking out the door and simply didn't stop you for one reason or another. I had some cases in my day where I had to break off the stop but I had everything I needed for it.

    Since it hasn't been said yet, STOP STEALING! You are helping drive up costs for the rest of us, not to mention jeopardizing your future when you get caught.

    As a note, I just made a burglary case against a guy who had come into the local WalMart previously and they suspected of shoplifting. A diligent employee found proof of criminal activity via tape and transactions and we sent it to the DA this morning.

    Yes, they CAN make a criminal case on the tape.

    Time to turn from this life of crime. A conviction for theft is a crime of moral turpitude and would make employment difficult for you ... time to straighten up before you DO get caught.
