My question involves criminal law for the state of: Texas.
My brother was sentenced to 2 years in prison 6 months ago. Prior to his sentencing, he served over 200 days in jail awaiting his trial for probation violation and other offenses. His attorney agreed several times to have his time served added to his judgment, but we have not been able to get his attorney to do anything. I need to take this matter into my own hands. I have copies of his judgments and county clerk records of time served. Is there a form that needs to be filled out to expedite the process? Who would be the individual to make the changes? The judge? The DA? Do I need to hire another lawyer for this? Or, is this something I can do on my own. If there is any advice that could be given in this matter I would be very appreciative.
