    Default Court Hearing for a Shoplifting Charge

    My question involves criminal law for the state of: California

    2months ago I was arrested for shoplifting. This is my second offence of the same nature the first time my case was dismissed. What can I expect on my court day? I spoke to a lawyer who said I have a good chance of getting my case dismissed again. Unfortunately I can't afford a lawyer at this time. I also spoke to a police officer I know who reviewed the police report and said that there was a 97% that my case wouldn't even make it to court but till this day I havent heard any news that it has. The reason I'm so hopeful that it will is because I didn't mean to shoplift it was a stupid mistake I regret everyday I put items in purse I had the intention of paying for but forgot to (I know a lot of you won't believe me and that's fine I'm not here to explain my actions I just want to know what to expect on my court day.) Although I didn't mean to steal the things I did pay the civil demand because I feel I should pay for my error and my mistake. I was advice no to pay but I really don't want to prolong this any futher with more demands. What are my chances in court? Thank you.

    Since you've given us no information as to the nature of the evidence they have against you (other than the fact that the items in question were in your purse), I've gone to the crystal ball.

    However, I will say, if this is the second time he/she has been caught, then I hope the long arm of the law applies an effecitve "Tony DiNozzo" style slap.

    Once you put the item in your purse - you have concealed it, and the intent is pretty clear. The courts have heard it so many times....my hands were full, etc. It comes down to that every store has things called shopping carts that you could have used. My hands get full at WalMart, I ask a greeter if they can bring me a cart or if I can leave stuff on a display while I get one....

    Since this is your second time being caught shoplifting...."I put these in my purse and forgot...." is not going to look good. I would guess the store has video, or atleast an LP Officer who will testify against you in court, as a witness.

    You are looking at (aside from the Civil Demand)....court costs, fines, fees, and a Criminal Record.

    I assume you are an adult...depending on the store, you may be entered into a National Retail Theft Database for 7 years.
    I assume you are also banned from the store and all it's locations for a long period of time.

    Had my court day today and I'm happy so say once again it got dismissed =)....

    Your not worth me getting mad specially on a day like this. And as of me proving you wrong lol the only people I need to prove myself to is the judge that's it.

    May I ask why the charges were dismissed? Did the store not show up? And were the charges nolle prossed or dismissed? There is a difference.
