Hi. My question involves a traffic citation from the state of: NJ. I am the manager of a condo building with assigned, deeded parking. One of the handicap spaces is deeded to a unit that my company owns that is currently vacant. Sometimes I would park in this space since no one else is permitted to. Today I got a ticket for parking in this handicap spot. Since this is private property that is not open to the public, I was under the impression that I could not get a ticket for this. I'm not being lazy; I am simply trying to keep my car in a spot that I know is vacant and not interfering with anyone else. I have two questions - can the police issue a ticket in this case? If they cannot, what do I need to say in court to fight it? I can supply the deed to the space space, and proof that I work for the company that owns the unit and space, and that it is vacant. If the police can issue a ticket in this case, do you think I can ask for leniency on the fine since its not like I'm willingly taking a handicap space from someone who needs it? No one actually can park in this space because it is deeded to my company. What should I say in court to ask for leniency or the fine be waived? Any assistance anyone can provide would be much appreciated. Thank you.
