    Post How Likely is Emancipation or My Sister Becoming My Legal Guardian

    My question involves juvenile law in the State of: Washington

    I dont know how to start this off and i didnt know what topic to put it under but im still hoping someone could help but anyways might as well begin with my background information
    Im a 16 year old teenager (just turned 16 in april) attending high school and part time college for free. I live in Washington state.
    I am currently unemployed but i am seeking employment as i am trying to live on my own which i know is nearly impossible.
    I am in a Long distance relationship that my parents do not approve of and they also do not approve that i do not wish to take any part in a religion.
    My mom and dad constantly come near to divorce, but my mom knows that she will not financially be stable if he does leave the house to us because we do have 11 acres of land with a small house that is hard to manage and he says he will just walk out and never talk to us again. So you can only imagine all the yelling, crying, and sometimes she doesnt come home because she is scared. She makes quite a bit of money but not nearly enough to take on the house, my dad makes the majority of the money so i dont blame her.
    I used to be suicidal because i couldnt handle my parents arguing and them yelling at me at all. I have visited the hospital two times and they did call poison control both times which i know probably ruins any chance of me leaving but my mom has even said that she doesnt care if we kill ourselves and sometimes tells me that she wishes that she aborted me. And i really cant handle that emotional stress, people constantly tell me "why havent you ran away already?" well because i know that if i do, i lose out on my education, and i know that i will just end up on the streets and i want to make something of myself.
    I try having conversations with my mom about how she isnt there for me but she will call me stupid, and say that i sound ridiculous and that i need "help." She tells my sister that she looks like crap and just treats her real bad but my sister is already 18 so she can leave. I learned from my sisters mistakes. Everytime we cry she just tells us to shutup and when i had gone to the hospital she said she wasnt going to take me and my dad had to if he wanted to but she wasnt going to. As i was leaving she called me stupid and crazy and it breaks my heart... it makes me feel like im not worth anything. i just cant do it anymore.
    My mom will tell me that she wants me out and they always say that to my sister as well. im sorry if this is long but i just want you to get the picture of what im experiencing.
    I recently stopped paying car insurance because my mom had taken twice the amount of what i need to pay and it made me very upset. I pay 100 dollars for my insurance because i havent gotten a ticket and have a 3.7 GPA. Ever since i got a temporary job they threaten to make me pay for everything. I figure if they want me to pay for everything i might as well be on my own, especially if they always tell me to move out. I know that i cant until i get a job and make enough money so i wouldnt leave till next year.
    Since my parents know that i am in a long distance relationship they know how to play with my feelings. My mom will threaten to take everything away from me when she gets mad at me or wants me to do something for her. She tells me that i need to get over it and sometimes i know shes right but i cant help how i feel.
    My dad recently got worse. He used to be normally just yelling and threatening to "throw a glass at our head" and such but now he is almost taking out his anger on my dog. which i guess is understandable since she had an accident :/ . He always calls us you-know-what suckers and pieces of.. you can finish that sentence. Sometimes he will throw stuff near us and hasnt hit us yet but i fear that its going to become physical. Much like my dad my mom asks me "what have you done thats good in your life?" trying to put me down. i feel like they dont love me and that they dont care and i dont want to be around this anymore. My mom looks at me disgusted because im fat, and she always tries to make me feel guilty about being chubby by saying "when i was in highschool i was a size zero"
    Im tired of all this. Im tired of being emotionally hurt.
    I know that i may not qualify for emancipation at all but would my sister at least be able to become my legal guardian so that i can live with her? I would still be paying rent and such while im with her but i really NEED out.
    Some people say "tough it out for another two years" but when im constantly crying its hard to focus on my school work. Its hard to do anything. :/ please help. Is there any way that i can get out?

    I am sorry but you are really going to have to tough it out until you are 18. Talk to your school counselor if you need help to cope with the situation.

    I'm going to be blunt with you, honey. You don't have a prayer of being emancipated and unless your parents both agree to it, your chances of having your only-two-years-older-than-you sister made your legal guardian aren't any better. I could go on and list the reasons why but you'd probably rather I didn't. The advice in the post above is good.

    Further, you have no legal right to be in a long distance, short distance or any type of relationship without parental approval. I suggest you stop complaining about your parents and how horrible you and every other 16 year old thinks their life is and perhaps you will not receive backlash.

    Then why are you here asking the question. They should be just dropping you off at your sister's house. No need for paperwork.

    Even WITH your parent's approval, you're not going to be emancipated. I can list three reasons just in your first three paragraphs why any petition for emancipation would be denied, whether your parents approved it or not.

    But if your parents are agreeable to letting you live with your sister, then all you need for that is their permission. The court doesn't have to sign off on that.
