My question involves name change laws in the State of: Massachusetts.

I have a 6 year old and i am no longer with her father. I left him because of domestic violence 4 years ago. He was ordered to pay child support but only paid for a few months, last payment was received march of 2012. He now has a warrant for his arrest in the state of florida. I have a fiance and were talking about getting married i have spoken to her biologic father once every couple months and last time he called he told me why should he pay if he doesn't see her. I am trying to change her name so when me and my fiance get married he can adopt her. I'm trying to find out if it's possible to change her name without his consent because i know he will never sign his rights over just to be spiteful, or what do i have to do to get her name changed. please help!!!

Holly, ask yourself this question: Will I be willing to allow my ex-husband (your now fiance) visitation with his child when we get divorced?

Your fiance should ask himself this question: Will I be willing to pay child support for a child that is not biologically mine when I divorce my wife?

If the answer to either of these questions is no, then don't bother with the stepparent adoption.
