    Default Giving Notice to a Tenant for Non-Payment of Rent

    My question involves an eviction in the state of: Florida

    I own a condo and rent out one of the rooms for $415/mo and we split the utilities bill. My tenant did not pay his $415 rent this month. I've given him verbally until the 16th to pay me the rent. If, at that time, he does not pay me anything what kind of written notice would I have to give him saying to either pay or he will be evicted and how long until i can evict?

    Also, I have a feeling his room is dirty as it smells, but I don't want to just barge in and check it out when he's not home cause I'm not sure if that's legal or not. Am I supposed to give a notice or advanced warning that I'll be inspecting his room before I can go in and what does that entail?

    The steps to evict someone in Florida are outlined in the attached. They start with a 3 day WRITTEN Pay or Quit notice giving the tenant 3 days (excluding Saturday, Sunday and legal holidays) to remedy the situation. If no success, you proceed as outlined:

    And, no you just cannot barge into his room. Again, you must post a notice (typically 24 hours) that states you intend to do an inspection. This may sound a bit crazy when one is renting out rooms but this is an often sensitive area between landlords and tenants.
