My question involves an easement in the state of:OH
A few years ago the telephone company installed a new pole that cut a major cable line at the street about a block away. The cable had to be completely replaced which was done using a horizontal drilling machine. The line was 'tunneled' up to 10' outside the depicted easement on the property. So far it has not been an issue, but am looking for information.
1 - can they do make up the easement size as they go?
2 - Isn't there some compensation involved in taking additional property and creating an easement?
3 - any idea of what the process might entail?
This is not a road easement, but runs along property lines into a housing development and is actually between 2 properties. One with an easement and the other without. The property without an easement has been encroached upon.
