    Default Who Gets an Apartment in a Divorce

    My question involves a marriage in the state of: Puerto Rico

    My boyfriend's mother is getting a divorce. Her husband (his father) hasn't lived in that apartment for more than a year and just today he is suing her and filed for a divorce. This guy is an abusive prick. Always has been. She has never had a job. She got married at 18 or 19 and gave birth to my boyfriend when she was 23 (he is 23 now). The father never let her have a job or anything so all her life she has never had a job but only took care of her son (my boyfriend). All throughout his life, his father has been emotional and psychological abusive and at times grabbed her by the arm and once had a fight with my boyfriend by the fists. He left the house in 2011 and never came back. Now he is "suing" her and filing a divorce. My boyfriend and his mom live together in this apartment and my boyfriend just got fired from his job. They have no money and owe a lot of money on the apartment. This guy is nuts in the head. What will she get out of this? Will they get to keep the apartment? I need advice and legal answers. I want to help any way that I can. What I really want to know is if she well get alimony and will she get to keep the apartment?

    See this is why we need one of the actual parties here.

    I mean, who owns it? Whose name is on the deed? How is the deed titled?

    Wait, that doesn't really matter.

    Since PR is a "community property" state, she's entitled to half the equity gained during the marriage. Of course, that also means she's entitled to pay half the debts acquired during the marriage.

    Nope. He didnt. They bought it after the marriage

    Claire, I'm really trying to help - but you're not making it easy. This is why many volunteers prefer not to deal with unrelated third parties - they rarely have all the info.

    However, I mean, they owe more than the property is worth.

    There's very little chance she and your bf will be staying in the property long. They best both make plans to live elsewhere.

    As for alimony - anything could happen. She'll NEED an attorney.
