    Default Common Law Marriage Property Rights

    My question involves a relationship in the state of: TEXAS

    After 13 yrs of common law marriage I'm being asked to leave. Do I have rights although everything is in his name?
    I came into this relationship with a car, a place to live and a job. Now I'm expected to walk away with the clothes on my back? We have bought a house (in his name) he opened his own company (in his name) and has been my workplace ever since the day he opened it ( as an employee ) I dont even have a vehicle in my name.

    Do I need to get a lawyer? Do I have any rights here? This is my entire life my house, my car, my job.

    If you either properly registered your informal marriage, or meet the three ponged test for Texas, you can file for divorce (must be within 2 years) and ask the court to divide assets, liabilities, assign spousal and/or child support, etc.

    If you're planning to seek a portion of assets held only in his name during the marriage, it's NOT a do-it-yourself project, and an experienced family law attorney is highly recommended..

    Yes, you do.

    Texas is a community property state.

    For you to get any share of anything you must prove you were married and end the marriage with a formal divorce

    If you can prove you were married, you do.

    But if you were foolish enough to think you had a common law marriage and didn't really have one, then maybe not.

    Hire yourself a good divorce lawyer right now. First thing tomorrow. He may be able to get an emergency injunction allowing you to remain in the house. You snooze, you lose.
