    Default Indicted for Criminal Assault, Criminal Trespassing, Burglary

    My question involves criminal law for the state of: Maine

    I have just found out that my brother was indicted for criminal assault, criminal trespassing and burglary. We are estranged because I had a falling out with my sister-in-law who encouraged my brother to drink and use drugs. I need to know the following so I can try to help him:
    1) - I know the name of the county handling the offense - how can I found out if he's currently being held in jail or if he's out, and also if and when a trial date has been set?
    -He was indicted in 2009 for assaulting a police officer during a DUI stop. In March 2013 when his case came up, the judge placed him on 5 years probation (until 2018), no jail time, but he has to report to a probation officer and is not allowed to drink alcohol or take drugs. Unfortunately, only a month later (April 2013), apparently he was smoking dope (and his friend also thinks he was on bath salts) and went on the rampage, breaking into a woman's house down the road and beating her and trying to strangle her, and luckily her 12 year old daughter managed to call 911 and saved her life. He was apprehended by the police whilst trying to run away. The woman he assaulted is a police officer's wife.
    2) - Because he was on probation when he committed this crime, will they give him a sterner sentence?

    You can try asking the jail if they have an inmate with his name. Some counties have the information available online.

    You can check the court to see if there's an open case file in his name, and if so you can see how you might learn the status of the case - you may have to go to the courthouse in person. Some counties have court dockets (or partial dockets) online.

    When people commit a series of crimes, that's likely to result in the judge sentencing them more harshly than if it's their first offense. Sentencing guidelines can potentially factor in.
