    Default Billed for an E.R. Visit After Almost Four Years

    My question involves collection proceedings in the State of: California

    In March of 2010, I broke my ankle and received services at the Emergency room for it. At the time, I provided my insurance card which clearly has the insurance provider's name and billing information on it.

    Through research now, they never billed my insurance provider. There is no record of claim submitted to them or denial.
    On their statement, it appears that they billed $462 to an affiliated company 7 months later in October of 2010, but never to my provider and not to the information on the back of my card. This statement shows that on 10/10, they changed my account status to "writeoff" and rebill to "Sonoma County EMSF", "straight collections"

    No statement or bill was sent to me at any time. No phone calls were made to me.

    On Friday, 3 years, 8 months later, I got a call, no voicemail was left. I called the number back and it was a collections company threatening to report me to credit agencies for a bill I never paid for over $600.00 (which doesn't match the $462 bill) I advised that I never received one. She told me it wasn't sent to me because they have no forwarding address. I said, I moved 9 months after the injury and forwarded my mail for 12 months after that. She told me that I should've checked to make sure it was paid.

    My insurance company is saying they will not process this due to untimely filing. If it were billed properly originally, it would have been paid.

    Where does this leave me? Are there any agencies I can speak to about this? I don't feel responsible for this since I have insurance to cover this and it is not my fault they did not the provider or contact me.

    Leaves you paying a $600 bill. Its YOUR responsibility to insure that your insurance is contacted promptly.

    Does the E.R. acknowledge that you provided your insurance information at the time of service?

    Were they in-network or out-of-network?

    If they acknowledge receiving the insurance information and are in-network, they may be contractually prevented from billing you for services they failed to bill to your insurer in a timely manner. If the facts support that possibility, talk to your insurance company about their contract with the provider.
