    Default How Long Does it Take a Landlord to Evict an Occupant After the Tenant Moves Out

    My question involves an eviction in the state of: Michigan

    Early This Year I moved in to a two-bedroom apartment with my girlfriend. We moved into an apartment owned by the same landlord that owned her last apartment. I thought I was going to be on the lease but I never signed it? However I see that on the lease it shows my name as "occupying the premises." I pay half the rent and all the bills every month.

    Me and my girlfriend broke up and she is moving out. I can handle the apartment on my own, but the landlord says he doesn't want me here.

    My question is this: If I am just on the lease as "occupying the premises," but never signed it myself, and my girlfriend moves out in a few days do I have any rights? If so how long until I can be evicted?

    (I just need a bit to save up to move into another place)

    If you didn't sign the lease, my guess is that you are on month-to-month.

    Except for a 7-day notice given under the authority of MCL 600.5714(1)(a) or a 24-hour notice given under the authority of MCL 600.5714(1)(b), if the lease agreement does not state otherwise, the landlord/landlady must give notice equal in time to at least one rental period.

    Keep in mind that it's not 30 days, it's at least a rental period.

    Example: If your rent was due August 1 (and you paid it) he would have to give you notice for September 30. If your rent is due tomorrow August 6, he would have to give you notice for September 5.

    You'll have to read the statute to see if notice has to be given in writing or not.

    As for eviction itself, that's a court process that doesn't start until you have remained in the apartment past the termination date.

    Thank you very much adjuster. I don't plan on getting evicted the. Just paid the rent. Should be ready to move in somewhere else by the end of the month. Just making sure.
