    Default Lying About Your Assets During a Divorce

    My question involves child support in the State My question involves child support in the State of: Georgia

    My Ex-wife, in the year leading up to the finalization of our divorce, had herself removed from 3 bank accounts that I know she was on with her mother (2, checking, and CD) and father (1, checking). She also failed to disclose her 401k. I'd like to mention that I was paying her 200-400 (my divorce decreed CS was almost $400/month) for the year prior to the divorce finalization. The only people Id be hurting if I hadn't would be my kids.

    The divorce was finalized 9/23/2011, and I'd like to know what is there a statute of limitations on perjury in a civil matter and how would I proceed. Not specifics, generally. i have Google'd, looked around, and found nothing that would answer my question. I've worked in the IT field for 18years and am very aware of how to search Google.

    All I want is a point in the right direction. thanks in advance.

    So, you are claiming that the money in the bank accounts belonged to your ex wife rather than to her parents? That you should have been given a share of that money even if it belonged to her parents and they had only put her on the accounts as a convenience?

    It does NOT work that way.

    I'm saying that, in discovery, she had to list (verbatim):

    12. Give the name and address of each bank, savings institution, or other financial institution in which you maintain a checking, savings, or security account, and state the value of such account as of the date of the answer to this interrogatory.
    13. Identify all stocks, bonds, notes and securities which you own individually and/or jointly with another or others issued by any government or agency thereof including, but not limited to, the name and address of the government and/or agency, the value of the items, a description, including the face or market value of the item, and the amount of income you receive therefrom.

    Her 401k, and the 3 accounts she was on were not listed. I could give a flip about the money. I do not want her 401k. I want to know did she commit purjury by not listing these accounts?

    Even if she did, perjury is rarely prosecuted and even more rarely is there a conviction.

    Let this one go.

    When did you first become aware of these accounts? Why didn't you raise the issue at that time?

    About 2 weeks after the decree was signed, and the threats started coming in. I went over all of the documentation, and noticed that.

    After having her fight me on every little issue (getting the kids passports so she can move to Spain, and her not letting me have 4 solid weeks of visitation over summer are two of the bigger ones) cost me $20,000. I had no problem with the state calculated Child Support. That is what I was paying the year BEFORE the divorce was finalized. I currently have 2 jobs, and need assistance to eat. I'm lucky enough to be staying in a friends guest efficiency, or my car would be my place of residence (did that for almost 2 months, it sucks). My ex lives with her parents, rent free, with the van that I paid off, and a job making what I do at my first job. She has stated to me, more than once, "When that 3 year wait is up, I'm going to take you back to court and have the child support recalculated to include your second job." WTF? I'm eating Ramon, and peanut butter sandwiches when I eat. TRUST ME when i say it's not about trying to take anything from her, it's about trying to keep the status quo on the settlement. I'm $15,000 in debt, and have collectors calling me ever day. I don't get to see my kids 2-3 times a year as she's moved them 10 hour drive away. I can't afford to get them for the 3 day weekends that I'm allotted for. I did that once, and only got to spend about 10-12 hours with them before I had to get them back. They were miserable and I hated doing that to them.

    Once again, llworking, I do not want anything from her! Her money, her car, house, or anything other than time with our children and the ability to live my life without the threat of immanent bankruptcy. I want to prevent the use of the system from taking from me what LITTLE I have left. I just need to know, is there anything I can use when she comes after me again?

    No, you cannot use any of this now because too much time has passed. In addition, you completely did not understand the point that I was attempting to make. Many, many people are on their parent's accounts for convenience purposes and/or estate planning purposes. That doesn't make the money the property of the adult child.

    The only possible issue would have been the 401k, and too much time has passed. Its something that should have been re-opened as soon as you found out about it, not years later.

    Child support is a calculation based on the incomes of the respective parents. You are working two jobs and living rent free (so you shouldn't be complaining about the fact that she is living rent free). Your debt level isn't outrageous. Something isn't right with that picture if you cannot afford to feed yourself.
