    Default Chapter 7 Discharge of Private Student Loans

    My question involves bankruptcy in the state of Georgia...

    Graduate student with degree, yet to get in my field and only making 20k a year, I am in the state of Georgia and really have a hard time with this so in hope To get this question answer would be great.

    I have several private loan that was taking out from 2002 to 2005 with Sallie Mae in the amount of 45k to 55k total... Can't get the loans consolidated nor have any more deferment for the loans. I was wondering would it be possible to place these loans on chapter 7 since the law was passed in 2005, would I be able place these loans that have occurred before the law was change. Again please help.

    You can "place" them in a Chapter 7 but they will not be discharged unless you file a complaint under 11 USC 523(a)(8) and win either a partial or full hardship discharge. Does not matter how old the loans are. What matters is that you would be filing AFTER October 17, 2005, the date the current law became effective.
