    Default What Constitutes Conspiracy to Commit Murder

    My question involves criminal law for the state of: All states (I believe it's a federal law). If it's a state law, than PA

    As I understand it, conspiring to do something illegal is in it of itself, illegal. Therefore, is the act of conspiring to conspire something illegal, illegal?

    To give an example, if two people plan to murder someone, that is conspiracy of murder. If those two people, planned on where and when to meet, to then plan on the murder, does it count as conspiracy of conspiracy of murder?

    Some teenager went to jail on a $500k bond for conspiring to kill a bunch of young school kids in a joke comment online. Look it up. So yeah, might want to check with a local lawyer to find out before you go conspiring to murder people. Whether serious or not!

    The charge would probably not be some meta conspiracy charge

    It would be conspiracy to commit murder

    Agreeing to meet to plan a murder is a conspiracy to commit murder.

    I don't state that I am doing the crime, so there is no crime that I am committing here. It's simply a hypothetical situation, which is much different than a joke.

    So then (absurdities of the situation aside) there could theoretically be an infinite amount of "conspiracy of conspiring of conspiring...", but the defendant would still be charged with conspiracy of murder?

    When you are conspiring to commit a murder, agreeing to meet at a location to refine your plan is not a separate conspiracy - it's part of the same conspiracy.
