    Unhappy Can a Sixteen Year Old Move Out and Directly Collect Social Security Benefits

    My question involves juvenile law in the State of: Idaho. I am trying to find out what a 16 y/o female's rights are in this state. She is living with another adult with permission from her mom and step-dad due to the fact that they do not get along. Her and her brother receive S.S. due to a horrible situation that happened when living with her mom and her mom's different boyfriend some years ago. Currently, her mom uses both her brother's and her S.S. and refuses to give this girl any money nor help her with any food or personal items yet she doesn't want her living at the house with them. Feels the teenager causes too many arguements. This is a mother who asked myself and husband (was her ex-husband but no relation to the teenager) to raise her. We raised her from 2 y/o to 7. Does Morgan have rights to her S.S.? Even though it's with mutual consent that Morgan doesn't live at home can her mom call her in as a run-away if she gets mad?

    No Morgan does not likely have a right to her SSI. That said, the status quo can certainly be shaken up. It will likely result in Morgan going home and a new Payee being appointed.

    What kind of "horrible situation" resulted in a minor child getting Social Security payments?

    Depending on the facts and the details, you might consider that if you or the girl push the issue of the SS funds, mom can simply pull the trigger and have the girl go home to live with her. If she wants the money and that's the way she can keep it, she can probably do that unless a court orders otherwise.
