    Question Can a Bank Account be Levied Based upon the Child Support Debt of a Beneficiary

    My question involves child support in the State of: Florida

    I would like to name my husband as POD for my bank account. This account is only in my name. However, my husband currently has a child support case in which he owes back support/arrears. There is currently being paid extra to it, but it will take about more 5 years to catch up completely. My question is, if I name him as POD, can the DOR #1 do anything to the money while I am alive, #2 levy the account after I die and take the money before he gets it, and #3 will either of those answers change once the account is caught up? They already levied a bank account that was in both our names.

    They should not be able to levy a bank account that just has him as a POD while you are alive. However, I would verify that with your bank. Yes, they could levy it after you die if there are still arrears. If the arrears are paid off, then they cannot levy anything.
