My question involves name change laws in the State of: Texas

I'm a mother of a 16 year old and she wishes to change her last name to a name that is niether her fathers or my legal last name. She has my full permission and support to do this. I'm not sure if her father will approve.

He is currently only paying a fraction of child support, and he has been for about two years. She doesn't keep in contact with him, so I'm assuming that contacting him out of the blue might not set well with him.

She is currently on probation for skipping a class for a week. Other than that, she's got a clean record.

My main questions are:

1. Can a 16 year old change her name to something that is not her fathers, nor my last name. (P.S she's not getting married or anything like that. She just believes changing her last name will help her move on from this rough time she's going through, and I fully support her decision.)

2. Can we still go through with it, even if we do not get her fathers consent?


3. How can a minor on probation change her name?

Any advice would be helpful!

She may not be able to change her name while on probation...aside from the issues of needing dad's permission. If she is 16, that means that she has less than 2 years to go until she can do it without anyone's permission (other than the courts of course). That would also give her some time to be sure that its really what she wants to do, and is not just an emotional reaction to things going on in her life now.
