Hi

My family and I are looking into the feasibility of relocating to the USA from the UK. My husband is an experienced Welding Inspector so we are looking into roles in Houston Texas where there are plenty oil and gas companies on the hope he will obtain sponsorship from an employer out there.

My question is, if he gets sponsored to work in the USA, would I as his wife also be entitled to a visa to go with him. In addition, we have 2 children ages 12 and 18 who will obviously come with us, but my husband is not their natural father so would they be entitled to a visa based on his sponsorship or even my entitlement to a spousal visa?

In addition, would I need authorisation from my 12 year olds' natural father to move abroad? I actually applied to move abroad (to Spain) several years ago because my mother lived there and at the time had to go to court for it. I did win the case and was allowed to move abroad then, but because the court case took so long we didn't end up moving because the children were settled in school etc. I'm not sure if this court ruling to allow me to take the children out of the country would still apply? The children's natural father hasn't visited or had contact with the boys for around 6 years, so I really don't think he would even notice, but I would rather be safe than sorry.

Another option may be for my current husband to adopt the children?

Any advice will be greatly appreciated.

Many thanks,
Marie
