    Default Can My Boyfriend Be Emancipated if I Am Pregnant

    My question involves juvenile law in the State of: Oklahoma

    PLEASE HELP!!!!

    I am 16 years of age, and my boyfriend is too. I am pregnant and I'm wondering if he can live with me if his parents drop him as a child legally, which they said they would if this ever happened... but, his mom is very very bipolar and changes her mind constantly, and she's a little verbally abusive towards him and his sisters. Also they've told him that they will not help help us take care of our baby.. we haven't told them yet, but they've said it before. I am worried that they may be able to separate us if we're not.married? Is that possible? Or does he have a choice whether or not he can stay with me? We have everything figured out for the most part, he has a job and he gets about 500$ a pay check, so can he emancipate himself? Or can his parents separate us for good until we're 18 or get married unless they drop.him.legally, we'll be living with my parents who are disappointed, but supporting us. What can you tell me about this? Also, i live in Oklahoma if that helps any.

    Emancipation is not available to him. It takes both parental consent and him to already be living independently at the time of the petition. Emancipation is a recognition by the court of a child that is already independent, and confers certain rights (ability to enter into contracts) that would be denied him otherwise that are necessary to live. Contrary to what you were led to believe in 8th grade social studies, Emancipation is not a procedure to free you from parental enslavement any more than the Emancipation Proclamation freed any slaves.

    If your bf's parents are willing to let him live at with your parents, that is fine. They may even get a guardian arrangement so they can legally act as a parent for him. If he is trully abused (which it doesn't sound like he is), alternative placement (not necessarily with you) is the answer, not emancipation. If your parents are amenable, you should all go to a lawyer to see if some meeting of the minds can occur, but it's not going to happen through Emancipation in Oklahoma.

    Until he is 18 years old and not one minute earlier, he is under the care and control of his parents. They have 100% say as to who he is allowed to see, where he is allowed to go, and most definitely with whom he lives. If they say that he lives at home and does not have any contact with you, then guess what? He lives at home and does not have any contact with you.

    Neither his nor your parents have any legal obligation to support the baby (though your parents are responsible to support you, and his parents are responsible to support him). If they choose to, all well and good. But they have no obligation to.

    An emancipated minor in OK has one right, and only one right, that a non-emancipated minor has not, and that is the right to sign a contract. It does NOT give him the right to move out without parental permission. Nor does YOUR being pregnant give HIM a valid reason to be emancipated under any state's laws. (No, it doesn't give you one either - the chances that a pregnant minor is going to meet the requirements for emancipation are too slim to be calculated - not to mention the fact that you've proven beyond doubt that you need more supervision, not less.)

    Honey, when babies have babies themselves they are telling the world "HEY we're ALL GROWED UP" and are expected to do so.

    Your boyfriend has zero chance at emancipation.

    And I'm being nice about it..
