    Default Can You Get Emancipated Without a Job or Means of Supporting Yourself

    My question involves child abuse or neglect in the State of: Okay so my girlfriend is currently in a home which is unstable in many ways. Her 22 year old sister lives there and she has a 20 month and a 5 month old baby. There is no way of transportation in the home and the mother of the baby's doesn't have a job. The mother of my girlfriend has anger issues and also has a boyfriend who watches teen porn, and pays for teen webcams. This same man took the 20 month old baby into a pool where they were both naked, and another time he had the baby on his lap while naked as well and he was on the computer. He also tells my 17 year old girlfriend that she has a nice body, butt, and breast. He also slaps her butt and tries to talk about sex with her. The other day the mother, who is dating this man, was yelling and swearing in front of the babies and then through hard plastic toy keys at the 5 month baby, which made her cry. So I decided I should leave because I didn't want there to be complications, but unfortunately it only made things worse. I got home and was telling my mom what has been going on and I hear someone walking up behind me crying. It was my girlfriend. Her mother asked why I left so she told her which sent her into a frenzy and told my girlfriend to leave and not come back. She stayed that night at my house and her mother didn't ask once if she was with me and/or if she was okay. The next day the mom called the police and even the police officer advised for her to stay at my house again, so she did. The next day she had to go home by law because her mother had told her too. When she got home her mother blew up again and sent my girlfriend in to tears once again. I called CPS the other day and they made a report but nothing has been done yet. Her mother keeps telling her to get emancipated but she doesn't have a job. My mom was going to take her in and can very easily take care of her as well. (For the record I also am 17 years old.) Is there any way she can be emancipated under these conditions with out a job?

    And what state would that be? Laws vary by state, so this is a vitally important question.

    She can report the battery to the police if she wishes. Or, if he lives in the home, to child services in her area as well.

    Mom can let her live wherever mom agrees to let her live even if she is not emancipated. Mom may not be so hot on emancipation as you might have been led to believe.

    Laws vary by state, and not every state allows for emancipation. NO state will allow emancipation so that she can go live with her teen boyfriend's mom.

    If her situation is bad enough that CPS or the police take action, she might be placed in foster care or with other family members. When she turns 18 she can make her own decisions.

    You have not indicated anything that is illegal occurring in the house. If the family is so poor, advise your girlfriend to stop wasting her time with you and get a job to contribute to household expenses.
