    Question Can I Sue a Store for Detaining Me on Suspicion of Shoplifting

    My question involves civil rights in the State of: ca
    as i was walking out of walmart, i was confronted by their l.p, who then accused me of having their merchandise in my purse, some earbuds in particular, i informed her that i didnt take any items that i left them in the basket, i proceeded to open my purse to show there was nothing inside and she still escorted me to their office at which time she insisted that i took some pink and black shoes that were my sons to begin with and rhey sure werent pnk/blk

    Your civil rights were not violated. You are free to file a complaint with the store's LP and regular management. They may throw you a little something to go away.

    so perhaps it wasn't my "civil rights" that got violated,but its more than "filing a complaint", i was publicly humiliated! whats worse,my children were scared....isn't there a certain procedure to go by in that situation? i was wrongfully accused and didnt even get an apology

    Yes, there are procedures that LP personnel must follow. It sounds like in your case, they messed up. I don't have all the facts though. You will get an apology when you complain, that is pretty much guaranteed. I don't know WM procedures but the places I've worked LP, you were supposed to apologize after a bad stop.

    The best thing for you to do is file a complaint.

    Just call the store and ask to speak to the manager or you can go down to the store and do it as well.
