Then the issue appears to be one of regulation, "A voluntary change of name, spelling of the given names or surname, or the order of the given names and/or surname as those names appear on the birth record shall not be reflected upon the birth record unless a request for the "correction" is accompanied by an appropriate court order." Illinois Admin. Code, Title 77, Sec. 500.40(l). If Illinois won't recognize an administrative order on the ground that it's not an "appropriate court order", then you're going to have to explore getting a court order from Texas or, if possible, from an Illinois court. You can schedule the court hearing for a date when you can obtain leave.
