My question involves a child custody case from the State of: New York
Ok long story short, The Non-custodial parent has supervised visitation with child, we have orders of protection against same. The supervisor is NonC parent's family member. Last visit the supervisor left child and NonC parent alone, not out of emergency or necessity, just because.... So now I have filed a contempt petition and a modification petition to have visits supervised by and agency in our county. The mediator said she will not modify the stip until NonC parent has a chance to come to court and address same and if parent wants to visit as per stip they can until otherwise ordered ( 2 months until next ct date). So even though this is not a life and death situation ( as allowed to refuse a visit) I am highly concerned for child's safety with this supervisor.
If I refuse am I subject to contempt punishment as well? I have no atty and can not afford one. What can i do? Do i seriously have only the option to continue the visits with the same supervisor that willfully neglected the terms of a so ordered court stip until otherwise ordered?? The mediator and the law guardian both said the stip is still valid so if I refuse what will happen? There are 2 other supervisors that are NonC parent family members ( which have stated in the past they do not want to do supervised visits) can I refuse if they are not willing to supervise as I don't feel comfortable with the original supervisor?
