I have writing on behalf of a friend that I feel is dying of stress. Her husband cheated on her for so many years. He took out a $100,000 equity on the house which she signed, but did not know anything else about it. Later on he suggested refinancing the property to combine both mortgage. Once that was done, he wanted a divorce. He makes $225k per year. He paid child support for the kids, but when her daughter turned 18 he stopped paying. She attended UCLA and had to pay everything herself. Long story short. My friend is now working 3 jobs just to keep up with the $3200 mortgage. She said that she have the rights to the house because of the kids. I said, what right? You're paying $3200 on your own! If she sells the property, it would require the ex's signature because it's joint property. He might demand half of the profit. He shouldn't be entitled any procedes of the sale because he didn't pay mortgage anymore. We're in California. R there any law that can help her?
