    Question Obtaining a Court Order for Physical and Legal Custody

    My question involves a child custody case from the State of: Ohio. I am trying to find out how to obtain a physical and legal custody court order for my niece. She was assaulted when she was younger and the offender is getting released from jail. She and her mother do not feel that she is safe in the state so they asked if I would be able to take custody. My niece is 16, I live in Nevada and her mother is putting her on a plane to me within the next few weeks. In order to provide medical and healthcare, I have to have a court order, signed by a judge.

    Would I do this or my sister? Would this have to happen in Ohio or Nevada? Both parents are willing to grant me custody but would a judge have to decide ultimately and if so what would be the deciding factor? I am also wondering if this would require for my husband and I to appear in court in Ohio if it has to be done there.

    It would have to be done in OH as OH currently has jurisdiction of the child. If the parents have an attorney draw up paperwork giving custody of the child to you, and the attorney submits it to the judge for signature, its unlikely that a hearing would be necessary.
