My question involves an easement in the state of: Colorado
I recently purchased a house that sits on a end lot in an older development and is part of a HOA. There is a new development (197 houses) going in next door and I did extensive research on the plans for that development prior to my purchase. I wanted to be sure that the development plans would not negatively impact my lot with either a new through street, blocked views, etc. I just returned from a 3-week trip to find that a new utility pole has been erected at the corner of my lot, which significantly alters the views from the back of the house. It turns out that the new developer wanted all of the lines/poles to the west buried underground, so a new pole had to be erected at the end of my development to accomodate this. The utility pole is not on my lot, but sits just outside the corner of my lot on what I'm presuming is a utility easement on the development that I live in. I just purchased this house 2 months ago and received no notice from the HOA in the disclosures during the buying process that these changes were being made. Nor did I receive any notice from the utility company. Had they placed the pole a mere 5 feet to the west it would not have impacted me, or anyone else for that matter. Do I have any recourse here?
