Can I Move With My Daughter and Unborn Son to Another State

My question involves a child custody case from the State of: NY . I'm currently 8 1/2 months pregnant and have a 19 month old daughter. I'm legally married but have not lived with my husband for 5 months now. I would like to move to Arizona to be with my family so I can have the extra help with the kids while I finish nursing school. My husband refused to look for a job because he was receiving maximum unemployment and thought he deserved a break after being in the military for 4 years. After 9 months of not doing anything but playing computer games he was finally asked to prove he had been looking for a job and couldn't so was cut off. Since he left us he doesn't pay child support or anything and we do not have any custody orders. He doesn't even ask to see our daughter unless his father asks him to bring her to a family event. He is trying to tell me he will take the kids from me if I attempt to take them out of New York. He's threatened for months that he would ruin my life and keep me here with no family. He doesn't even have a job or place to live in a few days because he is being kicked out of his friends house. If I were to leave next week could he do anything to force us back to New York?

He could rush to court and ask the judge to order you to return the child to NY, and he would have a decent shot at getting the judge to do so. It would be better for you to file for divorce and ask the court's permission to relocate with the children to AZ.
