    Default Military Landlord Wants to Break Lease

    My question involves landlord-tenant law in the State of: VA

    I just moved back stateside from an overseas tour in Dec. Renting a nice house from another active duty servicemember since Jan 1st of this year, with a 3 year lease. Landlord called the other day saying he and his family are moving out of state and want to sell the house, and giving us the option to move out. He would rather sell than hire a property manager. Truth be told, we want to stay...we just made an international move, we love the house, the neighborhood, the schools...we don't want to move. We looked over our lease and apart from the lease end date (Jan 2016) and the military clause, there's also a portion that says this:"If Landlord sells or otherwise transfers all or any interest in the Premises during the term of this Lease, Tenant agrees that Landlord may transfer the security deposit, plus any interest required by law, to the purchaser who in such event shall be obligated to comply with the provisions of this section." Am I accurate in my understanding this to mean that if they end up selling the property, the new landlord is required to honor our lease? What are my options as a tenant? I know my rights covered by a military clause, but what are his rights as a military landlord? Thanks...

    That's what is sounds like to me ~ and w/o it, the new owner would take over the lease anyways.

    He's a landlord, like all others. He wants you out? Up to you ... has he offered you any incentive to move out?

    If the house sells (and a three year lease is legal in your state), the new lease "rolls over" to the new owner. If the new owner wishes to reside in the property they can offer to "buy" you out of the lease (i.e., a "cash for keys deal") but you are under no legal obligation to accept this.

    The fact that the current owner is active duty military plays no role in his wanting to sell the property versus hiring a property manager to handle it....or in terminating your lease early.
