My question involves guardianship in the State of: Texas
Hello! Okay well my son is almost 5 and he is completely blind and is developmentally delayed. His biological father has not seen him in four and a half years and fiancé has cared for him since he was two. His biological father and I went to court for child support and they ran a paternity test and he has paid child support off and on since my son was 2. The court decided that he could only have supervised visitation for a long period of time until he slowly work his way up to taking him every other weekend but he never came to see him.
Well yesterday he contacted me to ask if we could agree on a decision as to what is best for my son. He said he had grown up and would like to see my son but if I didn't think that was in the best interest of my son then he would give up rights to my fiancé as long as I would agree to send him pictures every now and again and he wants to see him once a year. I don't think it's in my sons best interest because of many of the things him and his family have done to and said about my son and he is or was an addict but I have never heard of such an agreement when a parent gives up rights? Can we make some kind of legal agreement to allow him to see my son one a year and to send pictures to him after he gives up parental right?
