    Default Collection of Debt Owed to AAFES

    My question involves collection proceedings in the State of Louisiana: The first I heard of me owing a debt to the Army and Air Froce Exchange was when I was getting a refund from the IRS and was paid to the EXCHANGE. Now, this bill is ooooooold, like 2003 or 2004. A collection agency is now involved, NCO Financial, with a balance of $5,772.91 and interest accrusing every day.

    HELP ! ! ! What do I do???

    You've got a problem.

    The statute of limitations in LA is 10 years (LA Civil Code Section 3492 et seq).

    So the government may still have plenty of time left to file a lawsuit against you.

    Even if they don't, the SOL only applies to filing a lawsuit, not to collecting the debt by any other means.

    I'm guessing that a government agency can continue to intercept your tax return forever.

    I suggest you figure out what your potential refund for 2013 will be if you continue with the same W-4 exemptions and then increase your exemptions for the rest of the year by enough so that you don't get a refund. That way you get to keep your money.

    On the other hand, if you are still in the military, you face potential charges under the UCMJ Article 134.

    Beyond that, the best way out from under this is to pay it.

    And they have locked into my Social Security benefits, too. This is a mess ! ! !

    Apparently a debt to the federal government allows the federal government to take money without a lawsuit that wouldn't ordinarily be allowed to a private business.

    Consider talking to a bankruptcy attorney and see if this debt can be discharged in bankruptcy.

    That might end up being your only choice other than to figure out how to pay it all off as quickly as possible. As long as they can only take small chunks the debt is likely to double in the next 5 to 10 years and you'll be worse off.
