    Default Can I Get My Child Emancipated if I Can't Get Custody Modified

    My question involves a child custody case from the State of: Maryland

    I am the divorced father of a 16-year old. My child has lived with me for nearly three years yet remains in custody of my ex wife. I have filed modifications to custody several times but the case never seems to be heard in court. My child wished to become emancipated from her mother. Anyone have advice?

    Does your child have the means to support themselves: Do they have a job or a way of completely supporting him/herself, have they finished their eduation?

    She does not have the means to support herself. I support her. She will complete her education.

    Then she is not a candidate for emancipation.

    You cannot emancipate from just one parent. Either you are emancipated or you are not.

    Emancipation means that she is living independently and paying 100% of her own support. It does not mean that she cuts ties with one parents and the other takes custody.

    Then you're doing something wrong. Consider retaining a lawyer, as those facts should make it easy.
